TERMS AND CONDITIONS FOR USE OF THE SAFRAN MEDIA LIBRARY

The photographs which may be consulted and downloaded on the Safran website www.safran-media.com, hereinafter called the “Site”, constitute intellectual works, which are protected by the French Law 92-597 of July 1, 1992, concerning literary and artistic property. Non-compliance with the rights of the authors or rights-holders to these works, or with copyrights concerning their use, may lead to civil and criminal penalties.

The consultation, downloading and use of these photographs signifies the full and complete acceptance of the following terms and conditions. It is also specified that Safran reserves the right to change these terms and conditions at any moment, and that, in this case, any new consultation of the Site implies acceptance of these modifications.

Any use of the photographs in the Site, for reproduction, representation, adaptation or copying, by any process now known or to come, in whole or in part and in any form whatsoever, is forbidden (except for making a private copy, provided that it is personal, individual and non-transmissible), except under the following conditions and restrictions:

1. The Site is open/authorized exclusively to the following, provided that the persons concerned first register and provide identification :

1.1 Persons working in or for a media company (journalists, editor, graphic artist, research staff, etc.)

1.2 Employees of Safran and of Safran group companies and subsidiaries belonging to communications departments or divisions, or whose position involves the publication or implementation of internal or external communications media of any type on behalf of SAFRAN or a SAFRAN Group company.

2. Specific terms and conditions for the media

2.1 The use of photographic works offered in this Site is allowed solely for the illustration of articles, texts, reports and interviews concerning the activities and products of Safran Group companies, or directly related to Safran or a Safran group company.

2.2 Any other use than the ones defined in paragraph 2.1 above is prohibited, unless covered by a prior written agreement from the Safran Communications Division.

2.3 Any illicit use, in particular to illustrate articles or texts which are defamatory, offensive or designed to disparage persons or organizations, is strictly prohibited.

2.4 Photographs showing employees of the company Safran and/or companies and subsidiaries of the Safran group are transmitted under the terms and conditions described in paragraphs 2.1, 2.2 and 2.3. In no case may these photographs be sent to third parties, whether free of charge or for a price. Non-compliance with these provisions will be considered a breach of the legal rights related to the reproduction of physical likenesses of the persons in these photographs, and could expose the offender to a possible claim.

3. Specific terms and conditions for employees of Safran and Safran group companies

3.1 The use of photographic works is approved for the sole requirements of the internal and external communications of Safran and Safran group companies and subsidiaries, exclusively.

3.2 It is the responsibility of the user, for each image to be used, to make sure that the scope of reproduction and representation rights granted by the photographer is compatible with the planned use, if necessary by consulting the corresponding document or documents associated with the image, along with the information provided on the fact sheet.

3.3 For each image including employees, it is the sole responsibility of the user to make sure of the validity and scope of the copyright transfer for the image agreed to by the employees in question.

3.4 Images downloaded from the Site may only be sent to communications agencies, printers and, in general, any service provider working on behalf of Safran or a Safran group company to produce an internal or external communications medium, provided that they fully comply with the general terms and conditions stated in Section 4 below.

4. General terms and conditions applicable to all users

4.1 The “Copyright” mention of the owner or owners of the copyright must be displayed in compliance with current laws and regulations concerning intellectual property, for any use, reproduction or publication of any type whatsoever. The “Copyright” mention to be displayed is indicated in the fact sheet for each image.

4.2 Without the prior written agreement of the Safran Communications Division, no photograph from this Site is authorized to be used on the Internet, except to illustrate a site, with a maximum size corresponding to the screen (1024 x 768 pixels), and with a resolution of 72 dpi, nor may it be offered for downloading or copying in a resolution or size which would make it easily reproducible in high-resolution format.

4.3 By accepting the terms and conditions described above, the user of the photographs offered on the Site agrees to never undermine in any way whatsoever the economic and moral rights (copyrights) of the authors of the photographs that are being used, nor of the rights-holders, and to remain solely responsible for the use to be made of these photographs in relation to the authors of the photographs and to the rights-holders, of Safran and Safran group companies and subsidiaries, as well as to any third parties.

5. Disputes

5.1 Any disputes arising in the interpretation or execution of the present agreement shall be settled exclusively in Paris courts, under French law.
